Purchases of products or services made on Ekowallpaper.com (the “Site”) are governed by the following terms and conditions (the “Terms”).
By clicking the “I accept” button, the user (the “User”) accepts the Terms without limitations or reservations. The Site is owned by Eko Design Srl, a sole proprietorship based at Via Amerigo Vespucci, 163, 65126 Pescara, Italy, VAT IT01975560689.
1. Services Offered by the Site
1.1
The Site provides web-to-print services (collectively, the “Services”), particularly custom wallpaper and accessories printing (the “Products”) with home delivery, or third-party delivery through postal services exclusively within Italy (the “Postalization Service”). Unless otherwise specified, these Terms apply to all Services offered by Ekowallpaper.com, where applicable. Ekowallpaper.com may outsource the execution of Services to subcontractors or suppliers.
1.2
To access the Services, Users must register on the Site in the designated User area. During registration, Users will be asked to specify whether they are registering as a company, sole proprietor/freelancer, private individual, or association, as well as their nationality. Only purchases made by private Users are subject to consumer protection laws, as outlined in Legislative Decree No. 206 of 06.09.2005 (the “Consumer Code”).
1.3
All final prices of Services displayed on the Site are expressed in Euros and can be viewed with or without VAT, depending on the country or type of registration. Prices of Services may be subject to periodic changes. For specific Products and offers, shipping costs may be included, while for all other Products, they are borne by the User.
2. Product Selection and Purchase Process
2.1
The information and details on the Site do not constitute offers; they serve merely as an invitation for Users to submit purchase orders. The purchase proposal for Products is submitted by the User when they send an electronic order form at the end of the process described below.
2.2
Once authenticated, the User can select Products as described in the respective sections, customizing dimensions and quantities before adding them to their shopping cart. Some images may be illustrative and may differ from the actual Product appearance.
2.3
Unless the User selects images or designs suggested by Ekowallpaper.com, after confirming the quotation and completing the payment (except for cash on delivery and bank transfer options), the User will be required to complete the order by uploading the content they wish to print in the “File Upload Area.”
2.4
The User is solely responsible for verifying the content, spelling, and graphics of uploaded files.
2.5
After selecting the desired items, a summary screen will display the order details, including total costs and shipping fees.
2.6
After submitting the order, the User will receive an order confirmation detailing the type of Products ordered, their price, applicable taxes, shipping fees, and selected payment method. The contract is considered concluded and binding when Ekowallpaper.com sends the order confirmation to the User’s registered email.
2.7
Ekowallpaper.com reserves the right, at its sole discretion, not to process any order in cases including but not limited to:
Incomplete or incorrect User data in the order form.
The User not meeting payment conditions.
Ordered Products being unavailable.
If an order is not accepted, Ekowallpaper.com will notify the User via email, specifying the reason. In such cases, any amount already paid by the User will be refunded.
2.8
The contract will be archived, and the User may access it.
3. Payments and File Upload
3.1
Users can purchase Services online and make payments through various methods indicated on the Site. Payment information is transmitted via encrypted protocols to the financial institution handling remote electronic payments on behalf of Ekowallpaper.com, preventing unauthorized access by third parties. Orders are processed only after payment is received and after the uploaded file is deemed compliant.
3.2
For bank transfers, production will begin only after the funds are received, which may delay delivery by 2-3 days in addition to printing and shipping time. The order number must be included in the payment reference to identify the transaction.
For cash on delivery orders, production starts immediately upon file upload, ensuring no delay in delivery. However, Ekowallpaper.com reserves the right to refuse this payment method and will contact the User if necessary.
3.3
The invoice will be available in the User’s reserved area under a dedicated section, where it can be downloaded and stored according to applicable regulations.
4. User Responsibility for Uploaded Content
4.1
The User is entirely responsible for selecting the content and images to be printed and for obtaining necessary reproduction permissions. Ekowallpaper.com does not check content except for technical and graphic compatibility.
4.2
Ekowallpaper.com is not responsible for unauthorized use of images by Users or for any third-party rights violations.
By placing an order, the User indemnifies Ekowallpaper.com against any legal claims related to intellectual property violations, damage to image, honor, morality, or any financial or non-financial loss arising from printing the uploaded content.
4.3
Ekowallpaper.com reserves the right to block orders that:
Violate third-party intellectual property rights.
Contain defamatory, violent, or unlawful content.
5. Delivery Times and Shipping
5.1
The Postalization Service is available only within Italy.
5.2
Products are delivered on the dates selected by the User at checkout. Delivery timelines are based on the courier’s estimated delivery time, shown during the ordering process.
5.3
Shipping timelines are indicative and not guaranteed, as they depend on third-party couriers. Remote areas or islands may require additional delivery days.
5.4
If the User fails to upload the required file within 15 days of the order, it will be canceled.
If an order is canceled due to the User’s failure to provide necessary files, a €10.00 processing fee will be charged.
5.6
Ekowallpaper.com is not liable for any damage caused by delivery delays, as delivery is handled by third-party couriers.
